From the 1st October 2015, it will be illegal to smoke in a private vehicle when someone under 18 is present. This law applies to every driver in England and Wales and includes a driver who is seventeen years old or someone who holds a provisional driving licence.

This law has come into place to protect children and young people from second-hand smoke. Breaking the law will result in a fine of £50 which will be enforced for both the driver and the smoker.

The only instance when the law will not apply is if an individual is travelling alone in a vehicle or if the vehicle is a convertible car and the roof has been completely folded down.
